Personal Information Management Policies of Richemont Korea Ltd trading as Jaeger-LeCoultre
Richemont Korea Ltd trading as Jaeger-LeCoultre (hereinafter “Jaeger-LeCoultre”, “we”, “us” and “our”) hereby establishes and discloses the following personal information management policies for the protection of personal information of data subjects and a prompt and smooth management of any grievances thereon in accordance with the Personal Information Protection Act (the “Act”).

1.1 We may process your personal information for the purposes listed below on the basis of the following justifications:
Consent: this is the legal basis when you have given clear consent for us to process your personal information (for example, where you consent to receiving marketing information).
Performance of a contract: the processing is necessary for a contract we are entering into with you (including compliance with our Terms of Use), or because we have asked you to take specific steps before entering into a contract (for example, processing your contact information relating to the purchase and delivery of a product).
Legitimate interests: the processing is necessary to pursue our legitimate interests, provided these interests clearly outweigh the rights of the data subject. In such cases, processing will only be carried out to the extent that it is substantially related to our legitimate interests and does not exceed a reasonable scope.
Legal obligation: the processing is necessary for us to comply with the law (for example, a court order).
Other grounds: the processing may on occasion be necessary for other legal reasons such as to prevent and detect crime, to protect life or the processing is otherwise in the public interest.
1.2 We shall manage personal information for the following purposes on relevant justification. The personal information being managed shall not be used for any purpose other than those described in the following, and in the event of any material change to such purposes, we shall take required actions such as separately obtaining consent to such change or posting the revised policies on the website pursuant to the Act.
① Management of membership to the website
We shall manage personal information for the verification of the intent of an applicant to become a member, identification and authentication of an individual for the provision of membership services, retention and management of membership eligibility, verification of individual identity according to the execution of the limited verification of identities system, prevention of improper usage of services, various types of notifications, management of grievances, improving contents of the website and provision of customized web-based service to members, etc.
② Provision of goods or services, dealing with enquiries and requests, and management of accounts and records
We shall manage personal information to manage and fulfil purchase orders, sending of agreements and invoices, delivery of contents, delivery of customized services, identity and age authentication, payment or settlement of fees, and collection of debts, dealing with customers’ requests and enquiries, and management of our accounts and records etc. We shall manage personal information to send service-related communications, including announcements and administrative messages such as order confirmation and to manage and fulfil purchase, gift and repair orders or returns, communication preferences during repairs, to facilitate delivery and to provide after service care.
③ Management of grievances and legal compliance
We shall manage personal information for the verification of the identity of a person who filed a complaint; identification of the matter being complained of; contact and notification for inquiry of facts; and notification of the result of the grievance management, etc.
④ Customer management, market research, personalized services and marketing
We shall manage personal information:
· to deal with your enquiries and requests;
· for the purposes of sending you e-newsletters, catalogue, newsletter subscription, and marketing communications, direct marketing and advertisements in the business areas in which it operates and of providing information related to products, services or events relating to us and other third party partners that we think may be of interest to you through online display ads or using communication channels you have provided, including by telephone, email, post and electronic or text messages (including Kakao Talk, WhatsApp, Line or other one-t-one communications), and delivering personalized messages or advertising on social media or other digital platforms ;
· to share your personal information (such as your email address, usually in an encrypted or “hashed” form, or specific cookie data) with social media and other platforms or other service providers for the purpose of custom audience or lookalike matching, or intra-group client/prospect matching for marketing purposes;
· to conduct customer satisfaction survey and market research based on your purchases via your account or guest checkout so that we can continuously improve the service we provide to our customers; and
· to understand how our website and platforms are used so that we can continuously improve our platforms, services and other offerings.
⑤ Provision of integrated services
We provide the services, as integrated services of ① to ④ above, from all channels, including websites, mobile applications, boutiques and/or client relations center. Under the membership service, once a customer registers with us whether on the website or mobile applications, or with a boutique or client relations center, the customer can access services offered online, offline and client relations center to benefit from our products, services, events, boutique appointments and/or other client programme. Your account will store information about yourself, your purchasing history, unique account identification number, username, password, time zone, claims and repair history, as well as any conversation history. For example, a customer creating an online account would be able to receive both online and offline services. Where we invite customers to join its care program to receive international extended warranty, the customers can also receive membership services.
⑥ Events, appointments and communities
We process your personal information for the purposes of organising and running events, boutique appointments and membership communities, including registering you as a member, attendee or speaker, or reporting or logging a health and safety incident that you may have suffered or assisted with. We may also take photographs or make video or voice recordings of you at one of our events for promotional purposes.
⑦ Competitions, prize draws and other promotions
We process your personal information for the purposes of running competitions, prize draws, and other promotions, and we need to collect information from you to administer such promotions.
⑧ Regulatory compliance, credit checking and prevention of prohibited activities
We process your personal information for the purposes of undertaking anti-money laundering or international sanctions compliance, credit checking, prevention of fraud and other prohibited or illegal activities as part of our efforts to keep our Platforms and services secure or as otherwise required to respond to a legitimate request from a third party (for example, a regulatory or police authority or financial institution). We reserve our rights not to provide products and/or services to you where we have a legitimate reason not to do so in accordance with applicable law.
⑨ Automated technologies and profiling
We make decisions to process personal information using a fully automated system using AI technology (“Automated Decisions”). Accordingly, pursuant to Article 37-2 of the PIPA, we hereby inform you of the following matters concerning Automated Decisions:

We use innovative technologies (including profiling technologies, AI, machine learning and advanced algorithms) to help us identify and predict any products, diagnostics, services or other information that may be of interest to our customers and improve the customers’ experience of our products and/or services by way of offering you tailored products and/or services, and being able to respond effectively and swiftly to your feedback.
<Relationship between Key Personal Information Used for Automated Decisions and Automated Decisions>
(a) Types of major personal information
The key types of personal information of customers used in the automated system for profiling are as follows:
· Title, names, email addresses and phone numbers, country of residence and preferred language (including birthday, anniversary, preferred collection, wish list, country of residence) in customers’ membership accounts
· Order/purchases from our boutiques or e-commerce platforms
· Enquires/requests and grievances/complaints via phone, texts, emails, Kaokao talk, line or other one to one communications
· Customer satisfaction survey on our products and services
Any other information voluntarily provided by customers
(b) Relationship with Automated Decisions
We make Automated Decisions using the key types of personal information described above, in the process of dealing with customers’ requests, enquiries, complaints or grievance and after-sale services via calls, texts or emails for the following purposes: (a) sending the information regarding our products, services, event invitations, personal benefits and other information to you; (b) improving your experience of our products and/or services by way of offering you tailored products and/or services, and (c) being able to respond effectively and swiftly to your feedback.
<Considerations in the Automated Decision-Making Process and Procedures for Processing Key Personal Data>
This automated AI system used in the process analyses above personal information to predict your behaviour may include data clustering, data mining, data fusion or other data intelligence methods used to extract value and meaning from your personal information.
<Matters Concerning Processing of Sensitive Information and Personal Information of Children under the Age of 14>
We do not process sensitive data and personal data of children under the age of 14 in the Automated Decisions-making process. We do not collect any personal information from any minor who we know to be under the age of 14. In case we find that you are under the age of 14 but you submit your personal information to us, we will terminate services to you (including account cancelation) and delete such personal information as soon as possible.

⑩ New retail technologies
We may process your personal information for the purposes of our use of new retail technologies to provide you with enhanced in-store and online experiences, including virtual try-ons, augmented reality and product configurators. For example, we may use images or videos of your hand to generate and send you a photograph or a video clip showing product(s) on your hand – our primary justification is both legitimate interests (for example, to monitor client engagement with new technologies) and consent.
⑪ CCTV, video surveillance & Wifi processing
We process your personal information using CCTV and video surveillance data for the prevention and detection of crime, assisting law enforcement agencies in the apprehension, investigation and prosecution of offenders, ensuring the safety of our staff, visitors and property and, occasionally, to monitor in-store activity or WiFi browsing. ⑫ Platform support, maintenance and security
We process your personal information in connection with administering and protecting our business and the Platforms (including troubleshooting, dealing with error messages, data analysis, testing, system maintenance, support, reporting and hosting of data).
⑬ Receipt of products and services from suppliers
We process your personal information for the purposes of benefiting from any products or services provided by you or your organisation, where you are, or your organisation is, a supplier.
⑭ Business administration and legal compliance
We process your personal information for the purposes of the administration of our business or to comply with our legal obligations.
⑮ Enable a corporate transaction such as a merger & acquisition
We process your personal information for the purposes of any merger or acquisition activity and we will disclose your personal information to any third party that purchases, or to which we transfer, all or substantially all of our assets and business.
※ In commercial activities, we assume that a customer have the appropriate capacity for civil conduct. We understand the importance of safeguarding the personal information of minors. The Platforms are not directed at any minor who we know to be under the age of 14, nor do we collect any personal information from any minor who we know to be under the age of 14. We may collect your birthday information to verify your age. If you are under the age of 14, you should not use the Platform and should not submit any personal information to us. In case we find that you are under the age of 14 but you submit your personal information to us, we will terminate services to you (including account cancelation) and delete such personal information as soon as possible.

2.2 We manage the following items of personal information without the consent of customers or relevant individuals.
① Services that require processing of customers’ personal information, including product reservations and sales, service communications, programme updates, announcements and administrative messages, such as acknowledgement and confirmation of, or changes to, orders and shipment, confirmation of, or changes to, event or appointment bookings, repair notifications, to notify you about changes to our terms or privacy policy as well as send you service-related messages when you abandon your shopping cart or browsing session unexpectedly

① We shall manage and retain personal information within the legal retention and use period of personal information or within the retention and use period of personal information consented to by the data subject at the time of collecting personal information.
② The period of managing and retaining personal information for the purposes set out in Article 1 is as follows:
1. For the registration and management of membership to the website, we shall manage and retain personal information until 2 months following the withdrawal of membership from the website of business operator or organization; provided, however, in the case of an occurrence of any of the following events, until the end or resolution of such event:
1) Any pending investigation or probe following any violation of relevant laws, and
2) Any remaining debts or claims which arose from using the website.
2. For the provision of goods or services, we shall manage and retain personal information until the completion of the supply of such goods or services, and the completion of the payment or settlement of fees ; provided, however, that the personal information necessary for our accounting treatment or reflected in the books and records material to our business shall be maintained for 10 years pursuant to the Commercial Code of Korea.
3. For management of grievances and legal compliance, we shall manage and retain personal information until the service or follow-up service of customers’ grievances and complaints is completed.
For customer management, market research, personalized services and marketing, the personal information will be managed and retained until the time it is withdrawn by the customer.
4. For the provision of integrated services, we shall manage and retain personal information until 2 months following the withdrawal of your consent.
5. Notwithstanding the foregoing, we may retain customers’ personal information for a longer time period as required by applicable laws or government orders.
- Records on the contract or subscription withdrawal, etc.: Stored for 5 years pursuant to the Act on the Consumer Protection in the Electronic Commerce Transactions, etc.
- Records on the payment and supply of goods, etc.: Stored for 5 years pursuant to the Act on the Consumer Protection in the Electronic Commerce Transactions, etc.
- Records on the consumer complaints or dispute settlement: Stored for 3 years pursuant to the Act on the Consumer Protection in the Electronic Commerce Transactions, etc.
- Login information: 3 months pursuant to the Protection of Communications Secrets Act

① We shall manage the personal information of data subjects within the extent set forth in Article 1 (Purposes of Managing Personal Information). In order to better service customers and properly gather, process and manage customer data, we may delegate the management and processing of such personal information to its overseas affiliates listed in paragraph ⑥ below, in accordance with Article 28-8(1)(3)(a) of the Act, as necessary for execution and performance of contracts. We have entered into an agreement for delegation of personal information processing services with such entities.
② The date/time and method of transfer: transfer of personal information is carried out from time to time during the provision period of the services via electronic transfer using VPN.
③ The purposes of delegating the management and processing of the personal information include providing technical and IT system, storage and support for client data, conduct analysis and research based on transactions (including analysis of purchase preferences), arranging logistics and product delivery, providing customer services and all other sale, customer card and after-sale services, handling customer’s requests and complaints, and providing customer communication services (including sending e-newsletter and marketing communications on our behalf).
